This Privacy Policy (this “Policy”) describes the practices of MyBoomerang, LLC (“we” or “us”) for collecting, using, maintaining, disclosing, and otherwise processing (collectively, “processing”) the information that we collect from you or receive from others while using the Post Op Pal app (the “App”), as well as how we protect and secure such information. If you have additional questions regarding your rights under this Policy or any agreement you may have with us regarding your data, please contact us. Please read this Policy carefully to understand our processing of your information and how we will treat it.

This Policy generally applies to the information that we process. However, this Policy is subordinate to any specific terms and conditions set forth in any contract for services or other agreement you may have with us relating to a service or to data.

Further, this Policy applies only to information we process. This Policy does not apply to information processed by others, who may have their own privacy policies that apply to you. For example, we may maintain a presence on company websites and various social networking sites or services, such as Facebook, Instagram, Pinterest, or others. The information you post or provide through such sites and services is subject to the policies of the applicable site or service. Finally, this Policy does not apply to information processed by our clients, who similarly may have their own privacy policies that apply to you. It is our policy, however, to treat all information received from our clients with the same or greater care that they use.

1. What information do we collect?

We generally collect the information listed below that you provide when you register for and use the App: name, nickname (selected by you), age, weight, procedure being done, the date and location of the procedure, and the name of the surgeon performing the procedure.

2. Why do we collect this information?

We collect and process this information to serve you, to deliver our goods and services to you, and to improve our goods and services while processing information as may be necessary to support you in their use. We may also process your information as may be necessary to comply with a legal obligation.

To summarize, we process your information for the following purposes:

To prepare, deliver, maintain, or otherwise provide our goods and services;
To support and improve our goods and services;
To comply with applicable laws and regulations.

If we would like to process your information for any other purpose, we will disclose this to you at the time it is collected and may request your express consent.

To be clear, we are committed to respecting its customers’ privacy and will only process your information for the reasons disclosed herein or as requested at the time of collection, and then only in the context of your customer relationship with us. We will not sell, rent, or lease your information to others.

3. With whom will we share your information and how is it stored?

All information we collect (except for patient name, which is not saved), is stored on your device and encrypted. None of this information ever leaves the device, except that the location of your procedure may be shared with a third party (e.g., Google) to offer directions to the facility where the procedure will be performed.

We will maintain controls and oversight appropriate to ensure that any third party who we engage to assist us in processing your information will only have access to the information necessary to perform specific, designated tasks on our behalf, will only use the information for this purpose, and will protect your information to at least the same extent that we do.

Please note, however, that this Policy applies only to information that we process and share with others—it does not apply to information that you share with third parties.

If we need to share your information for a purpose not identified here, we will obtain your consent before doing so and will disclose this purpose at the time of obtaining your consent. For example, we may wish to use your information in demonstrations or other marketing materials and, if so, will contact you before doing so.

4. How long will we keep your information?

As explained above, all information resides on your device, except for patient name, which is not saved. You may view, update, or delete this information at any time.

5. How do we keep your information secure?

Taking into account the nature of the information gathered, we maintain a comprehensive security program that is reasonably designed to protect the security, confidentiality, and integrity of your information through administrative, technical, and physical controls appropriate to the sensitivity of the information. When developing or improving our goods and services, we incorporate privacy and security into our design. For example, all information stored on your device through your use of the App is encrypted. 6. What are my choices with respect to my information?

Your first choice is always to limit the information you provide. For assistance with exercising your choices, or if you have any questions about your choices, please contact us.

6. Regarding children under the age of 13:

Please note, we do not intend to collect information from children under the age of 13.

7. For international residents:

We are headquartered in the United States of America. We protect the privacy and security of your information in the manner described in this Policy regardless of where it is collected, stored, accessed, or otherwise processed.

8. Does this Policy ever change?

We may post changes to this Policy on this page. Please refer to the “last updated” date above. Except where otherwise indicated in this Policy or where required by law, we may or may not contact you directly concerning certain changes, and therefore we encourage you to visit this page periodically and check. By using our services or purchasing its goods after a change to this Policy, you are deemed to consent to any changes, unless otherwise provided by law.
